What is a Derivative Work?
A derivative work is a new creative work that is based on or derived from an existing copyrighted work. It modifies, adapts, or transforms the original material while incorporating elements of the original creation.
Examples of derivative works include remixes of songs, film adaptations of books, translations, musical arrangements, and sampled compositions. Even though the new work may contain original creative elements, it still relies on the underlying copyrighted material.
Because derivative works are based on existing copyrighted content, permission from the original copyright owner is usually required before creating or distributing them. Without authorization, producing or sharing a derivative work may constitute copyright infringement.
